依现行法,我国慈善组织尚无独立的法人资格,这影响了其在构建和谐社会中的作用。慈善法律制度的缺失和不完善造成了慈善组织建设的滞后;慈善组织本身存在的问题也影响了民众捐赠的积极性。慈善事业的发展需要实现政府与慈善机构的分离,需要法律制度的完善,需要加强慈善机构的组织建设,以发挥慈善事业在维护社会公平正义、构建和谐社会中的作用。

According to the present law,the charitable organizations in our country have not established the independent status of juridical person.This is not benefit to exerting its function in the construction of the harmonious society.The flaw and imperfect of the charitable law leads to the lag of the charitable organization in construction,and the problems of the charitable organizations itself have dampened the enthusiasm of populace donation.In order to play the role of the philanthropy in maintaining social justice and constructing the harmonious society,the development of the philanthropy is in need of realizing the separation of the government and the philanthropic institution,is in need of perfecting legal system,and is in need of strengthening the organization construction of the philanthropic institution.
